§ 1. GENERAL PROVISIONS
1. These regulations define the terms and conditions of the Loyalty Program, hereinafter referred to as the Program.
2. The Program's Organizer is the owner of the Varlesca store: VARLESCA Beata Gęsicka ul. Wejherowska 56a, 84-240 Reda, entered into the National Court Register under the KRS number: 0000881258, Tax ID: 588-246-55-76, REGON: 388067390 hereinafter referred to as the Organizer.
3. The program was launched on October 4, 2022.
4. Awarding of loyalty points began upon the Program's launch.
5. The Customer joins the Program by: creating a user account in the www.varlesca.com online store (hereinafter: "Online Store"). Upon joining the Program, the Customer becomes a Club Member.
6. The terms and conditions of participation in the Program are governed by these Regulations, which will be published on the www.varlesca.pl website.
7. The Organizer reserves the right to make changes to the Regulations at any time during the Program's existence, provided, however, that the introduced changes will not limit the Club Members' rights in regards to Awards or participation in dedicated promotions under the Program on the terms applicable prior to the amendment of the Regulations. Information concerning amendments to the Regulations will be published on the www.varlesca.pl website. In the event of not agreeing with the amendments to the Regulations, the Club Member may withdraw from the Program at any time.
§ 2. LOYALTY PROGRAM TERMS AND CONDITIONS
1. The Loyalty Program is a special program intended for all customers of the Varlesca.pl Online Store who have created a user account in the Varlesca Store.
2. You can check your current Program participation status at the website: varlesca.pl/program.
3. To join the Program, a User must:
• create a user account in the varlesca.pl Online Store,
• read the Loyalty Program terms and conditions and the privacy policy,
• agree to electronically receive marketing and commercial information regarding the products and services offered by varlesca.pl to the e-mail address assigned to the customer's account,
• express willingness to participate in the Program by clicking the "I want to join the Loyalty Program" button,
• confirm their willingness to participate in the Program by clicking the "I confirm my participation in the Loyalty Program" button and confirm their consent to receive marketing and commercial information by clicking the "I confirm" button.
4. Only persons of legal age may participate in the Program.
5. The account of the Club Member who confirmed their willingness to enter the Program should feature the required personal data (name, surname, e-mail address, telephone number),
6. The Club Member is obliged to comply with the terms of these Regulations.
7. An account participating in the Program will be deactivated upon withdrawal of consent to receive marketing and commercial information regarding products and services offered by varlesca.pl to the e-mail address assigned to the customer's account.
§ 3. RULES FOR AWARDING AND USING THE LOYALTY PROGRAM DISCOUNT
1. When making purchases in the Online Store, a Club Member accumulates loyalty points, where they receive 1 loyalty point for each PLN 1 spent. Loyalty points are added to the Customer's account and can be converted into a discount voucher (referred to as a bonus).
2. Products for which points are awarded from the loyalty program are marked on the website. There is a number of points that the customer will receive, given at each product. Points are not awarded when purchasing discounted products.
3. Discount codes generated from Loyalty Program points do not encompass discounted products or ones covered by another promotion,
4. Club Members using the Loyalty Program are awarded an amount Bonus equivalent to 5% of the value of each purchase made in the Online Store. Using the Bonus is done on the terms and conditions set out below. The bonus is not convertible into cash. The amount bonus is calculated and then mathematically rounded to the nearest PLN.
5. Discount codes generated from points cannot be used when the customer's cart contains a product included to the "Gift vouchers" category,
6. 1 loyalty point is converted into PLN 1. The Club Member may convert the points into a discount code at any number of accumulated points, provided that all points accumulated will be converted into 1 discount voucher after clicking "Convert to discount code". The Generated Discount Code is not redeemable for loyalty points. The discount voucher may at most cover 50% of an order value.
7. The Club Member may use the bonus within a period of up to 180 days. After the above-mentioned deadline has expired, the Bonus accrued from a given transaction is deleted, which, however, does not affect the Bonuses accrued from subsequent transactions. Information about the discount voucher's validity date is available on the user's account.
8. The bonus from a given transaction can be used after 25 days from the sale in a given transaction. The date of the fiscalisation of sales within a given transaction is considered the performance a sales. Sales fiscalisation takes place upon sending the order.
9. All information concerning a Club Member's account status and the accrued Bonus is available at varlesca.pl,
10. The Organizer reserves the right to temporarily change the amount of the awarded Bonus. The Bonus acquired prior to the change to its amount can be used on the terms applicable before its change.
11. If the Bonus has been awarded or used in violation of the Regulations, the Organizer will be entitled to cancel part or all of the accrued Bonus, of which the Club Member will be informed.
12. The Customer forfeits the discount code from the Program in the case of: cancellation of an order, return of goods, failure to claim the order.
§ 4. PERSONAL DATA
1. The Customer's personal data are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) – hereinafter referred to as "GDPR". The Controller of the Loyalty Program Member's personal data is the Program Organiser.
2. The Club Member may read the personal data processing terms in the Privacy Policy of the varlesca.pl store.
3. The Club Member is obliged to notify the Organiser of any changes to their personal data contained in the registration form. In the absence of such notification, the Organizer shall not be liable for any delays or lack of information concerning current promotions intended for Program Participants, provided that the lack of notification concerns personal data necessary to provide such information.
§ 5. CLOSURE OF THE PROGRAM. WITHDRAWAL FROM PROGRAM PARTICIPATION.
1. The Organizer reserves the right to suspend or close the Program at any time during its duration, subject to respecting the rights acquired by the Club Members.
2. In the event of termination or suspension of the Program the possibility of accruing the Bonus is blocked on all Cards and Club Members' accounts, which does not affect the Club Member's right to use the Bonus accrued on their account within 180 days of making individual transactions.
3. In the event of the Program's closure or suspension, the Organiser is obliged to publish appropriate information on the varlesca.pl website and notify the Club Members via e-mail or in another form chosen by the Organiser.
4. The fact of the Program's closure or suspension by the Organiser does not entitle the Club Member to claim payment of the Bonus in cash against the Organizer.
5. Withdrawal from Program participation takes place at the Customer's request, after contacting the Customer Service Office at the following e-mail address: [email protected] and after withdrawing the consent to electronically receive marketing and commercial information regarding the products and services offered by varlesca.pl to the e-mail address assigned to the customer's account.
§ 6. FINAL PROVISIONS. COMPLAINT PROCEDURE
1. The Club Member is entitled to submit a complaint related to the implementation of terms and conditions of the Regulations, in particular in the scope of the Bonus granted or the discount implementation. A complaint should be submitted within 30 days from the occurrence of the circumstances justifying its submission. The complaint should be sent via e-mail to: [email protected]
2. The provisions of Polish law, including in particular the Act of 23 April 1964 Civil Code (Journal of Laws 1964.16.93, as amended), shall apply to the extent not governed by these Regulations.
3. Any disputes arising in relation to the application of these Regulations shall be settled by the competent court in accordance with generally applicable legal provisions.
